According to the documents, the defendants claim that the diagnosis of Ahmaud’s mental health, which, when left untreated, explains why he turned to Travis McMichael during their confrontation. The judge also said that the medical records that the defense wanted to present as evidence were from a single hospital visit and that the alleged “diagnosis” was from a registered nurse who had not even been trained in mental health.
“There is no evidence that the victim suffered from any mental health problems or was otherwise compensated on 23 February 2020,” Judge Walmsley wrote. “Instead, the defense appears to want to use the records to make relevant evidence of” other acts “already excluded by that court in a previous order.”
He also wrote: “The ‘diagnosis’ contained in it was made by a registered nurse who was not officially trained in mental health, but instead took an ‘online’ course, which she would review and read, after which she did short test at the end. This RN was tasked with questioning Arbery and proposing a mental health diagnosis. A Gateway nurse met Arbery for half an hour the same day, then confirmed RN’s diagnosis and gave him a prescription. There was no follow-up, no feedback from Arbery, no long-term treatment to suggest that this “diagnosis” was correct or that the prescription was helpful in any way. ”
In just a few weeks, McMichals, along with her friend William “Roddy” Brian, will face trial for Ahmoud’s murder in February 2020.
